This Limited Warranty applies to any BASIS Panel that (1) was purchased from BASIS or a BASIS-Approved Electrician (defined below) in New Zealand; (2) is installed by a BASIS-Approved Electrician in New Zealand; (3) is registered by completing the commissioning process at the time of installation by a BASIS-Approved Electrician via the BASIS Trade App and (4) has been issued a Certificate of Compliance and Electrical Safety Certificate by a Basis-Approved Electrician. As used herein, the term “BASIS Approved Electrician” means a registered electrician who has completed BASIS training and testing, and meets and maintains BASIS standards for quality workmanship, insurance, use of brand guidelines, and customer satisfaction and responsiveness.
Subject to the terms and conditions set forth in this Limited Warranty, each BASIS Panel is warranted at the original address of installation to the original purchaser; and to each subsequent authorised owner of the original address of installation, against defects in materials and workmanship that occur under normal use for a period of twenty four (24) months (the “Warranty Term”). This warranty term will begin either upon the delivery of the product from BASIS or upon the date of installation of the BASIS Panel at the original address of the initial purchaser, whichever occurs earlier.Ownership changes within this period do not extend the warranty beyond the initial 24-month period.
If during the Warranty Term, you become aware of the existence of a defect in a BASIS Panel, you must advise BASIS as soon as possible and provide such information as BASIS may request evidencing the defect, including but not limited to, photographs of the BASIS Panel and proof of purchase and allow BASIS or a BASIS Approved Electrician access to the premises at which the BASIS Panel is installed for the purposes of inspecting it. If BASIS confirms the existence of a defect that is covered by this Limited Warranty, BASIS will, in its sole discretion, either repair your BASIS Panel, replace your BASIS Panel with an equivalent product, or refund you the price you paid for the BASIS Panel. For warranty replacements, BASIS will cover the actual costs of labour, parts, and dispatch of service personnel to complete the replacement. If your BASIS Panel is repaired or replaced under this Limited Warranty, only the remainder of the original Warranty Term will apply to the repaired or replacement product. Under no circumstances will the original Warranty Term be extended as a result of your BASIS Panel being repaired or replaced.
Except for the express warranty contained in this Limited Warranty set forth above, BASIS makes no other express or implied warranties or guarantees.
If you are purchasing a BASIS Panel for personal, domestic or household use, nothing in this Limited Warranty modifies or excludes the warranties and guarantees or your other legal rights, under the Consumer Guarantees Act 1993 (CGA). If you are purchasing a BASIS Panel for the purposes of trade, to the maximum extent permitted by law, the provisions of the CGA do not apply to the supply of the BASIS Panel or this Limited Warranty and you agree that it is fair and reasonable that you are bound by this clause.
This Limited Warranty does not apply to any defect or loss of product functionality resulting from any of the following: (a) abuse, misuse, negligence, animal damage or water damage; (b) accidents or force majeure events, including but not limited to lightning, flood, earthquake, fire, or other events outside the reasonable control of BASIS; (c) transport, storage or modification of your BASIS Panel; (d) installation, commissioning or repair of your BASIS Panel, removal of tamper seals or inspector seals, or opening internal component housing of your BASIS Panel performed by anyone other than BASIS or a BASIS Approved Electrician; (e) failure to install, operate or maintain your BASIS Panel in accordance with the BASIS Panel User & Installation Manual, including use of power supply outside the operating range of the product or installation in an area where the environment is outside usual residential parameters; (f) failure to install your BASIS Panel in accordance with the applicable electrical, fire, and/or building code(s) and/or regulation(s); (g) any attempt to modify your BASIS Panel, whether by physical means, programming or otherwise; (h) damages as a result of connecting your BASIS Panel to an unsecure, vulnerable, or public network, or any attempt to subvert the safety or security of the system; (i) removal and reinstallation of your BASIS Panel at a location other than the original installation location by an electrician that is not a BASIS Approved Electrician,; (j) failure of any remote firmware update to the BASIS Panel as a result of a failure of your internet connection (k) In addition, this Limited Warranty does not cover (a) normal wear and tear or deterioration, or superficial defects, dents or marks that do not impact the performance of your BASIS Panel; (b) damage or deterioration that occurs after the expiration or voiding of the Warranty Term; or (c) theft of your BASIS Panel or any of its components.
BASIS reserves the right to deny warranty coverage upon examination of the BASIS Panel by BASIS or an Authorised Installer. You will be liable for and shall pay for all field charges for labour or other expenses incurred in connection with a claim for warranty coverage that is denied.
You must utilise the BASIS Panel and associated hardware strictly in accordance with the provided instructions, guidelines, and intended applications. Any use of the BASIS Panel and/or associated hardware for purposes other than those explicitly specified by BASIS or beyond the scope of its intended functionality is expressly prohibited.The BASIS Panel is not intended for use with life-support systems, medical installations, or any use other than residential situations, or any other use where loss of supply could lead to injury to persons or loss of life .BASIS disclaims any and all liability arising out of any such use of your BASIS Panel.
BASIS shall not be liable for any damages, losses, or injuries arising from the misuse, unauthorised modifications, or improper handling of the BASIS Panel and/or associated hardware beyond the prescribed use outlined in the documentation.
To the maximum extent permissible under applicable law, BASIS shall not be liable for any consequential, incidental, indirect, special, damages arising out of or related to this limited warranty, including, but not limited to, loss of time, loss of income, loss of use, loss of personal or commercial property loss or damage to associated equipment, damages to tangible or intangible property, other than the equipment covered by this limited warranty, cost of substituted or replacement equipment other than as expressly warranted, damages associated with excessive over voltages; regardless of the form of action and regardless of whether BASIS has been informed of, or otherwise might have anticipated the possibility of such damages. BASIS’s liability arising out of a claim under this limited warranty shall not exceed the amount paid for the panel. Notwithstanding anything contained in this Limited Warranty, BASIS will not be liable for any damages, losses, or injuries arising from the misuse, unauthorised modifications, or improper handling of the BASIS Panel and/or associated hardware beyond the prescribed use outlined in the documentation or as a result of the BASIS Panel being used in a manner that is contrary to the “Limitation of Use” section above
